DWI Penalties in the State of Texas

A DWI first offense in the state of Texas is classified as a Class B Misdemeanor and carries certain ranges of punishment upon conviction, including a large fine, probation, community service, and potential jail time. Certain conditions may also be imposed by DWI courts in Texas that include drug and alcohol evaluation, a DWI education class, and attendance at a Victim Impact Panel where victims of drunk drivers speak about the perils of DWIs and DUIs.

Second DWI offenses will typically result in increased jail time, a higher fine, community service, and may include the use of an ignition interlock system in a person's vehicle.

A third (or greater) DWI offense is considered a third degree felony in Texas and carries much more severe penalties, including a maximum of ten years in prison and a fine up to $10,000. Other DWI related crimes that are considered felonies include intoxication assault and intoxication manslaughter.

All of the penalties in these cases are based upon state guidelines but the discretion of the judge or jury will always have the biggest impact on the actual penalties levied against someone convicted of a DWI.
